Order & Installations Terms & Conditions

1. Unless prior to a written agreement to the contrary, these terms shall be incorporated as conditions of any order, quotation or contract accepted by the company.

2. Prices are based on the current price list and are exclusive of VAT which will be charged at the rate ruling at the time of dispatch. These prices may be changed by a specific agreement in writing.

3. Any additional work, whether it is necessary remedial work brought to your attention or requested additional work, will be accurately priced based on time and materials. The cost of this work will be added to the final invoice, which if not already paid, is due for payment upon completion. If you require an estimate for any extra work, please contact our office promptly. We will not proceed with any additional work without your explicit consent. This includes addressing any unexpected circumstances such as nail pops or plasterwork issues in the room or any adjoining rooms.

4. No order may be cancelled by a customer without our consent in writing. ACS Group reserves the right to claim all loss and expenses which may be incurred as a result of cancellation.

5. Non-delivery and shortages. Notification of non-delivery/shortages/breakages must be made in writing within 2 days from the invoice date or date of delivery for all dispatches by ACS Group’s own transport. For deliveries made by outside carrier notification, as above, must be made within 2 days from invoice or delivery date. If ACS is not made aware of any shortages or damages within the above timescales then the cost is to the purchaser.

6. Product returns: The quotation provided includes all the products required for your installation. These products are either ordered into stock or made to order specifically for your installation. It is essential that you are completely satisfied with the choice of all the products, as items made to order are non-returnable. Stocked items can be returned upon our consent, but they will be subject to a restocking fee, which varies between 30-40% of the Recommended Retail Price (RRP), plus transportation costs. Please note that this returns charge is imposed by our suppliers no ACS group. If you have any doubts about the suitability of any item, we recommend consulting with us before the commencement of the installation, as changes cannot be made after the work has begun.

7. Timber products: If your installation involves items made from timber, such as furniture, toilet seats, bath panels, or hardwood flooring, it is crucial to follow a proper maintenance regime after the completion of the installation. Timber products can be exposed to moisture in bathroom and kitchen conditions. It is of utmost importance to ensure that all moisture is thoroughly removed from the product after use, as water can eventually penetrate any surface coating and cause damage. Therefore, any guarantees relating to timber products will not cover damage caused by water ingress. Please report any leaks in furniture immediately and take the necessary steps to prevent water ingress.

8. Completion and final payment: Please be aware that the acceptance of a quotation is conditional upon the full payment of our invoice upon satisfactory completion of the installation. The invoice will include any additional supply items and installation work that were not included in the initial quotation. Until the invoice is paid in full, all goods will remain the property of ACS Group.

9. Installation or removals: We will make every effort to ensure that your installation starts on the scheduled date. However, there may be instances where installations or removals could exceed the estimated time or experience delays due to factors beyond our control, such as delayed components. The provided time scale for the installation or removal is an approximate guide, and the actual completion time may vary due to various factors. Additional fees may apply if there are delays or restrictions in accessing the site. If parking is limited, please inform us 48 hours in advance of the installation date, and kindly specify the floor where the work will be carried out. In the event that the lift is out of order on the scheduled date, additional fees may be incurred. For both removals and installations, it is the customer's responsibility to ensure that all items are cleared from the room and that easy access is available. Additional charges may be added if access is denied/restricted to agrees areas or rooms on pre-organised dates.

10. The Company cannot accept liability for damage occurring to concealed electric cables, conduits, or pipework that is not visible or clearly marked.

11. It is the Customer's responsibility to ensure that there is a supply point for each required service of gas, water, and electricity within the room where the installation will take place. Furthermore, these supply points must conform to the necessary standards and regulations.

12. The Customer assumes responsibility for all materials left on-site and partially completed installations. The Customer will be held liable for any theft, accidents, or damages, whether caused by malicious intent or negligence, that may occur to these materials or installations. It is the Customer's responsibility to secure adequate insurance coverage to protect against any potential loss or damage arising from these situations.

13. ACS Group cannot accept liability for repairing defects in masonry, plaster, wall covering, floor covering, woodwork, or ceilings that are revealed or created during the removal of existing units, partitions, wallboards, tiles, or other forms of decoration. For instance, popped nail heads on adjacent rooms, including walls and ceilings, fall under this category. We recommend the Customer to make necessary arrangements for the remedial work required to address such defects.

14. Waste removal: All installations will include a skip for waste disposal. However, please note that we are not registered waste carriers, and therefore, fridges and freezers cannot be placed in the provided skips. It is the Customer's responsibility to make suitable arrangements for the proper disposal of these items in compliance with relevant waste disposal regulations.

15. We have established partnerships with sub-contractors who specialize in the removal of fridges, freezers, and similar items. If needed, we can provide this additional service through our trusted partners. Please let us know if you would like to include this service in your project, and we will provide you with the necessary information and associated costs.
